The Kurdish Lawyers Union, as a legal and human rights organization registered in the Federal Republic of Germany, and based on its professional commitment to protecting the rule of law and preserving fundamental freedoms in accordance with the areas enshrined in international law, expresses its deep interest and condemnation of the dangerous military escalation and systematic violations targeting Kurdish civilians in various parts of Kurdistan.
These actions, according to documented evidence and facts, constitute a pattern of hostile behavior that amounts to international crimes, which requires the activation of international accountability and accountability mechanisms in accordance with international human rights standards.
First: Military aggression and targeting of civilian objects
The Union condemns the military and missile operations launched by the Iranian authorities against the Kurdistan region and the regions of “Rojhalat Kurdistan”, as they represent a direct threat to regional peace and security.
Targeting populated areas and civilian facilities is:
- A flagrant violation of the principle of “prohibition of the use of force” stipulated in the United Nations Charter.
- A violation of the principles of “discrimination and proportionality”, which constitute the cornerstone of international humanitarian law.
- A direct attack on the “right to life and personal security” protected under the International Covenant on Civil and Political Rights.
Second: The systematic siege and obliteration of cultural identity (Roj Avai Kurdistan)
The Union expresses its strong condemnation of the unjust siege imposed on the city of Kobani, which is legally classified as a form of “collective punishment” prohibited under Article (33) of the Fourth Geneva Convention of 1949.
The Union also denounces the ongoing violations in the Afrin region, particularly the suppression of celebrations during Nowruz, the vandalism of cultural facilities in the village of Midano, and the removal of national symbols. These practices fall within the framework of policies of “cultural erasure” and demographic identity change, which contravene the Universal Declaration of the Rights of Indigenous Peoples and the International Convention on the Elimination of All Forms of Racial Discrimination.
Third: Arbitrary arrests and international obligations (Bakuri, Kurdistan)
The Union denounces the widespread arrest campaigns carried out by the Turkish authorities against Kurdish civilians and activists. The Union asserts that these practices violate the European Convention on Human Rights –to which Türkiye is a party–, particularly the articles relating to the rights to liberty and security (Article 5) and freedom of expression (Article 10).
Fourth: Legal adaptation and demands
The Kurdish Bar Association asserts that the practice of these acts as part of a widespread or systematic attack directed against a civilian population places them under the Rome Statute of the International Criminal Court, as crimes against humanity.
Accordingly, the Union calls on the international community and international organizations to:
- Open an independent and impartial international investigation into the reported violations and officially document them.
- Activating the principle of “non-impunity” and prosecuting those responsible for issuing orders to target civilians before international courts.
- Obligating the lifting of the siege on the city of Kobani and ensuring unconditional access for humanitarian aid in accordance with the rules of international humanitarian law.
- Affirming the inherent right of the Kurdish people to self-determination and the preservation of their cultural and political identity, in accordance with Article 1 of the United Nations Charter.
Fifth: Conclusion
The international community’s silence regarding these violations undermines international justice. At the Kurdish Lawyers Union, from our headquarters in Bonn, we will continue to serve as a legal platform for internationalizing these issues and ensuring the protection of the human rights of the Kurdish people throughout Kurdistan.
